Purpose of workshop:
(a) It is a constitutional requirement that a provincial Act provide a procedure to amend money Bills. KZN does not as yet have the envisaged legislation but we did commence with benchmarking initiatives against the Parliamentary Budget Office (PBO) and the Gauteng Provincial Legislature and a draft of the Bill has been developed. This legislation is expected to enhance the exercise of oversight over the provincial executive on the provincial budget.
(a) We proposed this workshop for the purposes of benchmarking with key legislatures and institutions that will assist in finalizing our own KZN Money Bills Amendment Process legislation namely the KZN Money Bills Amendment Procedure and Related Matters Bill, 2023.
(c) The 2 provincial legislatures that have developed their S120(3) legislation, namely Gauteng Provincial Legislature (GPL) as well as the Eastern Cape Provincial Legislature (ECPL) are here today. The GPL has just finished their feasibility study with regard to the implementation of their Act and we can learn from the results of this study. The ECPL have a similar model to that of the KZNL and have completed their member capacitation towards the implementation of their Act. It is therefore imperative to obtain updates on the implementation process of these 2 legislatures who have enacted money Bills amendment process legislation for purposes of discussing their models, noting their implementation challenges to date so as to learn from and guard against same as a province. This will enable us to finalise our KZN model and Bill in a well-informed manner.
(d) The Parliamentary Budget Office (PBO) and the Financial Fiscal Commission (FFC) have been invited as they can assist our KZNL as they possess relevant experience and expertise with regard to money bills which we hope they can share with us at this workshop and in subsequent engagement. We also wish to explore strategic partnerships with them as we understand that they have also been involved in member capacitation in the ECPL in respect of money Bills amendment. As our Bill does not have an external outside unit like the PBO, which may result in criticisms of impartiality and independence, by forging these external partnerships with the FFC as well as the PBO, the KZNL can ameliorate these types of criticisms.
